  1. Introduction  

Please read this page carefully. It contains the terms and conditions (the "Terms and Conditions") applicable to this website  http://enajsingh.co/.  

This governs the access to and usage of the Ena J Singh Web Sites and the Services provided by Ena J Singh. If you do not  accept these Terms and Conditions or you do not meet or comply with their provisions, you may not use the Ena J Singh  Web Sites or Services. These Terms and Conditions are effective as of 1st July 2024.  

  1. Binding Agreement  

These Terms and Conditions (as they may be amended from time to time by Ena J Singh) form a binding agreement (the  "Agreement") between you and Ena J Singh. The access to or use of the Ena J Singh Web Sites or Services indicates your  acceptance of these Terms and Conditions. By such access or usage the user agrees to:  

2.1 Use the Site at it’s own risk.  

2.2 Have this policy as a legally binding agreement.  

2.3 Give consent to the collection, storage, processing and transfer of any or all of your Personal Information and Non Personal Information by us.  

  1. Certain Definitions. The following definitions apply to this Agreement:  

3.1. "Ena J Singh Web Site" or the "Site" (collectively, the "Ena J Singh Websites" or the "Sites") means any  web site under Ena J Singh's control, whether partial or otherwise and includes such Site's Content, Ena J Singh  Materials and Services (as applicable in each context).  

3.2. "Content" means Ena J Singh's web pages, web forms, programming (including software code used on the  Sites and in the Services, including (i) product specifications, product images, and object libraries, (ii) all third party or open source code embedded therein, and (iii) any upgrades, updates, releases, fixes, enhancements or  modifications to the foregoing), graphics, images, design (color combinations and page layout), text,  information, data, stored in various commercial databases operated and licensed by Ena J Singh, data submitted  via the Sites by Users and other content made available through the Sites by Ena J Singh.  

3.3. "Products" means any goods sold by Ena J Singh or its agents described herein.  

3.4. "You" or "you" means the person who (or the entity on behalf of whom you are acting) that is agreeing to  these Terms and Conditions.  

3.5. "User" refers to any individual or entity that uses any aspect of the Sites or transacts with Ena J Singh.  

  1. User Information  

4.1. To avail certain services on our Website, users are required to provide certain information for the registration  process namely: (a) your name, (b) phone number, (c) email address, (d) other contact information, (e) postal  address, (f) age, (g) PIN code, (h) payment options, (i) your occupation, interests, and the like. The Information  as supplied by the users enables us to improve our Website and provide you the most user-friendly experience.  

4.2. All required information is service dependent and we may use the above said user information to, maintain,  protect, and improve its services (including advertising services) and for developing new services.  

4.3. Such information will not be considered as sensitive if it is freely available and accessible in the public domain  or is furnished under the Right to Information Act, 2005 or any other law for the time being in force. A record of  your product interests may also be maintained and/or acquired about you from our present and/or future  affiliates.  

4.4. This Website is directed to be used by adults only who are above the age of 18 years. If you are not an adult, you  may look at our Website, but you should not make a purchase, register, or submit personal information to us. We  do not knowingly collect information from minors. Minors should not be using this website with any personal  information. In an event of default by the minor, the parent or the guardian will be liable to compensate for  whatsoever damages arising out of such wrongful use by the minor.  

  1. Cookies  

To improve the responsiveness of the Website for our users, we may use "cookies", or similar electronic tools to collect  information to assign each visitor a unique, random number as a User Identification (“User ID”) to understand the user's

Your IP address does not identify you personally. We use this information to deliver  our web pages to you upon request, to tailor our Website to the interests of our users, to measure traffic within our Website  and let advertisers know the geographic locations from where our visitors come.  

  1. Information Sharing  

 We share your Personal Information with service providers to help us provide our services and fulfil our contracts with you,  as described above.  We share the sensitive personal information to any third party without obtaining the prior consent of the user in the  following limited circumstances:  

- When it is requested or required by law or by any court or governmental agency or authority to disclose, for the  purpose of verification of identity, or for the prevention, detection, investigation including cyber incidents, or  for prosecution and punishment of offences. These disclosures are made in good faith and belief that such  disclosure is reasonably necessary for enforcing these Terms; for complying with the applicable laws and  regulations.  

- We propose to share such information within its group companies and officers and employees of such group  companies for the purpose of processing personal information on its behalf. We also ensure that these recipients  of such information agree to process such information based on our instructions and in compliance with this  Privacy Policy and any other appropriate confidentiality and security measures.  

  1. Retention  

We will retain your personal information for the period necessary to fulfil the purposes outlined in this Privacy Policy unless  a longer retention period is required or permitted by law.  

We may retain your personal information for a longer period to address a complaint or if we reasonably believe that  litigation in respect to our relationship with you is possible.  

We may anonymize personal information for research or statistical purposes, in which case the resulting data are no longer  personal information subject to this Privacy Policy and we may use these data without restriction.  

  1. Information Security  

We take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or  destruction of data. These include internal reviews of our data collection, storage and processing practices and security  measures, including appropriate encryption and physical security measures to guard against unauthorized access to systems  where we store personal data.  

However, we shall not be liable to any user for any loss, damage (whether direct, indirect, consequential or incidental) or  harm caused to the user due to the unauthorized access or misuse of the Personal or Sensitive Information by any third party.  We cannot guarantee that information you supply will not be intercepted while being transmitted to us over the Internet.  Further, any information you include in a posting to the discussion areas is available to anyone with Internet access.  

  1. Use of Personal Information  

9.1 MARKETING EMAILS  

The information you have chosen to provide may be used by us to create and deliver to you emails such as our  newsletters, surveys or other email messages containing product and event information or promotions. If at any time  you decide that you would not like to receive these emails, you may select the ‘Unsubscribe’ link on the email or

9.2 TEXT MESSAGES  

If you have chosen to leave your mobile phone number on the Website, you may receive text message/SMS alerts  containing product and event information or promotions on your mobile phone. Please note that we will never send  you any unsolicited text message on your mobile phone. We do not charge any fee for you to receive any text  message from us. However, your mobile service provider may charge you for sending and/or receiving text  messages and air-time, as well as any other standard applicable rates charged by your mobile service provider.  9.3 TELEPHONE CALLS  

If you have chosen to leave your mobile phone number or landline number on the Website, you may receive phone  calls containing product and event information or promotions on your mobile phone or landline phone.  9.4 COMMUNICATIONS TO SERVE YOU  

If you have chosen to provide us with your contact information, we may provide you with service-related  announcements by any means, including email, concerning the Website or contact you regarding your customer  service requests or questions. For example, all registered users will receive a welcoming email to confirm their  registration. These types of communications are necessary to serve you, respond to your concerns and to provide the  high level of customer service that we offer our customers.  

9.5 CUSTOMISED SERVICE  

We may use your personal information that you have chosen to give us, to provide you with customized service and  use of our website. For example, we may suggest products that would be of particular interest to you. Such  customized information may be conveyed to you by way of emails, text messages and phone calls.  

9.6 CONCERNING FACEBOOK  

On our pages, you will find a button linking to our Facebook and Instagram page. Please note that, with the use of  this button, the data about the visit to our pages can be linked to your Facebook / Instagram profile. If you do not  wish to transmit data to Facebook / Instagram, please ensure that you are logged out of Facebook while logging on  to our pages.

  1. Delivery of Goods  

  

10.1. Orders readily available in our inventory shall be processed within 7 working days.  

10.2. For orders that require fresh inventory production, shall be processed within 15-30 working days from the  date of receipt of orders. The timeline for processing of orders might vary depending upon the customization and  will be communicated to the customer within 2 working days from receipt of the order on email.  

10.3. The timeline for delivery of orders shall be dependent upon the location of delivery.  

10.4. For domestic orders – the delivery should happen within 2-3 working days from dispatching of the order.  10.5. For international orders, the delivery should happen within 15 working days from processing of the order  and shall be paid by the customer in advance.  

10.6. Shipping and delivery time for international orders is going to be dependent upon the location of delivery.  10.7. All orders within India shall be shipped via BVC Logistics and/ or Sequel Logistics which is a third party  for Ena J Singh.  

10.8. All orders outside India shall be shipped via Ferrari/Fed-EX/UPS Priority which is a third party for Ena J  Singh  

10.9. All users shall receive a confirmation mail on the receipt and shipping of order respectively.  

  1. Exchanges  

11.1. It is our endeavour to provide full customer satisfaction with respect to the products available on our  Website/App, security & customer assistance.

11.2. The user may request an exchange of the goods delivered only within 24 hours from the delivery of the  order, such exchange shall be a zero-deduction exchange.  

11.3. A product will be acceptable for exchange only if the same is in perfect condition with all the tags, product  certificate, invoice and protective material intact. Any product returned with any kind of wear and tear or with  tampered tag will not be eligible for exchange. Once the product is returned, it would go under a thorough  examination for any tamper by the Quality control department (QC). Any exchange shall be subject to the  examination of QC. Any exchange request for a product that has been used or damaged, shall not be entertained.  

11.4. Acceptance of any exchange/ return is subject to satisfactory examination of authenticity, originality,  damage, cracks, and alterations etc. Hence, handing over the products will not tantamount acceptance unless  specifically accepted by EJS.  

11.5. EJS reserves the right to accept or not to accept the any exchange/ return after quality inspection.  11.6. For an exchange after a period of 7 days, a restocking fee of 10% of the order value will be levied on the  exchange of diamond jewellery and 25% of the order value will be levied on the exchange on uncut diamond or  polki jewellery.  

11.7. For the exchange to happen, the item should be in the same condition as it was purchased (security tag/  label).  

11.8. No taxes such as GST or any government tax levied on the Invoice shall be refunded back to the customer  in such scenario.  

11.9. The user shall have to bear costs of shipping the goods back.  

11.10. The user will not hold EJS liable for any deterioration, damage or loss of the said Jewellery or otherwise  while conducting the examination and testing for the purpose of above assessment and/or after the completion of  the assessment.  

  1. Returns  

12.1. If an order is processed incorrectly or you receive a damaged item, we will replace it or accept it for a full  refund at our expense.  

12.2. Acceptance of any exchange/ return is subject to satisfactory examination of authenticity, originality,  damage, cracks, and alterations etc. Hence, handing over the products will not tantamount acceptance unless  specifically accepted by EJS.  

12.3. EJS reserves the right to accept or not to accept the any exchange/ return after quality inspection.  12.4. The user may request a return of the goods delivered only within 24 hours from the delivery of the order,  such exchange shall be a zero-deduction exchange. For any return to happen, the item should be in the same  condition as it was purchased (security tag/ label/ certificates/ markings). Any return request for a product that  has been used or damaged, shall not be entertained. This is only applicable in case the order is processed  incorrectly or a damaged item is received.  

12.5. For a return during the entire lifetime of the jewel, a deduction of 10% of the order value will be levied on  the return of diamond jewellery and 25% of the order value will be levied on the return on uncut  

diamond/jadau/polki jewellery.  

12.6. No taxes such as GST, TCS, etc levied on the Invoice shall be refunded back to the customer in such  scenario.  

12.7. The user shall have to bear costs of shipping the goods back.  

  1. Refund  

13.1. The refunds for any exchange or return cases shall be made only after 21 days post receipt of the product.  13.2. The refunds shall be only via bank transfers and the same shall be made only to the person to whom the  product was invoiced to.  

13.3. Before processing of the refunds, Ena J Singh shall first inspect the products for any damages on the same.  

  1. Payment Terms  

14.1. Payments in full are essential for us to start processing any order.

ENA J SINGH  

14.2. Any payments made through this website are routed through an external payment gatewat and we shall not  be responsible for any payments stuck with the payment gateway. 

14.3. We do not stor an payment details such as Net Banking Credentials, Debit/ Credit Card Details with us. 14.4. We accept the payments via NEFT/ RTGS/ Bank transfers, American Express, VISA/ Mastercard credit cards,  debit cards, Razorpay and Paypal. 

14.5. In case, the payments are made via NEFT/ RTGS, the name associated with the payment account should  match with the user ordering the product. 

14.6. For international orders, it is necessary that the payment may be made through a SWIFT transfer or via Cards. 

  1. Third Party Providers  

You acknowledge and agree that Ena J Singh may provide the Services using third party providers, including  subcontractors and consultants (the "Third Party Providers"). You agree that, as between Ena J Singh and its Third-Party  Providers, Ena J Singh will have sole responsibility for handling all billing and contract negotiations.  

  1. Links to Other Sites  

Ena J Singh contains links to third party web sites. These links are provided solely as a convenience to you and not as an  endorsement by Ena J Singh of the contents on such third-party web sites. Ena J Singh is not responsible for the content of  linked third-party sites and does not make any representations regarding the content or accuracy of materials on such third party web sites. If you decide to access linked third-party web sites, you do so at your own risk.  

  1. Amendments to this Agreement and Changes to Sites  

Ena J Singh may revise these Terms and Conditions at any time by updating this page. Changes will be binding on you on  the date they are posted on the Sites (or as otherwise stated in the any notice of such changes). Any use of a Site will be  considered acceptance by you of the then-current Terms and Conditions (including any exhibits thereto) contained on such  Site. If at any time you find the Terms and Conditions unacceptable, you may not use the applicable Site any longer. Any  new or different terms supplied by you are specifically rejected by Ena J Singh unless Ena J Singh agrees to them in a  signed writing specifically including those new or different terms. Ena J Singh may change the Sites at any time.  

  1. Indemnity  

You agree to defend, indemnify, and hold harmless Ena J Singh (and its subsidiaries, affiliates, officers, directors,  employees and agents) from and against any third-party claims, actions or demands (including, without limitation, costs,  damages and reasonable legal and accounting fees) alleging or resulting from or in connection with your use of the Sites,  any Document posted by you, your use of the Services or your breach of this Agreement. Ena J Singh shall use reasonable  efforts to provide you a prompt notice of any such claim, suit, or proceeding and may assist you, at your expense, in  defending any such claim, suit or proceeding.  

  1. User Information and Privacy Policy. 

19.1. When you register on any of the Ena J Singh Sites or in connection with the Services, you will be asked to create an  account and provide Ena J Singh with certain information, including but not limited to, a valid email address ("User  Information"). You acknowledge and agree that you have no ownership rights in your account.  

19.2. All User Information will be used in accordance with the terms of Ena J Singh's Privacy Policy. Please note, as set  forth in the Privacy Policy, that Ena J Singh may collect certain User Information and may contact Users periodically in  accordance with the terms of the Privacy Policy. In addition, Ena J Singh reserves the right to comply, in its sole  discretion, with legal requirements, requests from law enforcement agencies or requests from government entities, even  to the extent that such compliance may require disclosure of certain User Information. In addition, third parties may  retain cached copies of User Information.  

  1. Applicable Law and Jurisdiction – Delhi  

20.1. This agreement shall be governed by, and construed in accordance with, the laws of India without regard to

principles of conflict of laws.  

20.2. Disputes which cannot be resolved amicably as mentioned above, shall be settled by arbitration as per the Indian  “Arbitration and Conciliation Act, 1996”.  

20.3. The parties hereto consent to and agree to submit to the exclusive jurisdiction of the courts of Delhi, India for any  action or proceeding arising under or by reason of this agreement.
